CONTRACTUAL TERMS AND CONDITIONS
The assets subject to these contractual conditions are sold by the Arance Delizia Agricultural Company of Fagone Maria Febronia, with registered office in Palagonia (CT) Via Cav. Di Fazio n. 14, with VAT number 05653550870, hereinafter referred to as supplier.
1.1 The expression "On-line sales contract" means the sales contract, relating to the goods offered by the supplier stipulated between them and the purchaser in the context of a remote sales system, via telematic systems.
1.2 The term "Purchaser" means the consumer, a physical person who makes the purchase, referred to in this contract.
1.3 The term "Supplier" means the person indicated in the inscription, or the lender of information services.
2.1 With this contract, respectively, the supplier sells and the purchaser buys remotely through electronic means, well indicated and offered for sale on the site.
2.2 The products referred to in the previous point are illustrated on the page.
3-Procedure for stipulating the contract
3.1 The contract between the Supplier and the Buyer ends exclusively through the internet through the Buyer's access to the address www.arancedelizia.it where, following the indicated procedures, the Buyer will come to formalize the proposal for the purchase of the goods referred to in point 1 of the previous article.
4-Conclusion and effectiveness of the contract
4.1 The purchase contract is concluded through the exact compilation of the request form and the consent to the purchase manifested through the acceptance sent online in which the details of the ordering party and the order are shown, the price of the purchased good shipping costs and any charges and accessories, the methods and terms of payment, the address where the goods will be delivered, delivery times and the existence of the right of withdrawal.
4.2 When the Supplier receives the order from the Purchaser, it will send a confirmation e-mail or display a confirmation web page and order summary, printable, in which the retrieved data must also be reported to the previous point.
4.3 The contract is not considered completed and effective between the parties in default of what is indicated in the previous point.
5.1 All sales prices of the products displayed and indicated on the website www.arancedelizia.it, are expressed in euros and constitute an offer to the public pursuant to article 1336 c.c.
5.2 The sales prices, as per the previous point, include VAT and any other tax.
5.3 The prices indicated for the goods offered to the public are valid until the date indicated in the price list.
5.4 Shipping costs and any accessory charges are expressly indicated and calculated in the purchase procedure before the order is forwarded by the purchaser and are also contained in the summary order web page.
6-Product features and availability
6.1 The essential characteristics of the goods are those contained in the description in the data sheet of each product.
6.2 All products for sale online are available in stock, except where otherwise indicated.
6.3 The supplier ensures through the electronic system used the processing and processing of orders without delay. For this purpose it indicates in real time, in its electronic catalog, the number of available products, as well as the shipping times.
6.4 If an order exceeds the quantity existing in the warehouse, the Supplier, by e-mail, will inform the Buyer if the good is no longer available or what are the waiting times to obtain the chosen good, asking if it intends to confirm the Order or not.
6.5 The Supplier's computer system confirms the registration of the order as soon as possible by sending the user a confirmation by e-mail.
7.1 The payment methods available are online payment by credit card, PayPal, payment by bank transfer in advance and cash on delivery.
7.2 Payment by bank transfer must be made no later than three days from the date of the order and must be communicated via relative no. CRO.
7.3 Electronic payments are managed on behalf of the operator by accredited institutions that use the most modern standards of security and confidentiality.
8 - Limitations of liability
8.1 The supplier assumes no responsibility for disruptions caused by force majeure, if he is unable to execute the order within the time stipulated in the contract.
8.2 The supplier cannot be held responsible to the purchaser, except in the case of willful misconduct or gross negligence, for disservices or malfunctions connected to the use of the internet outside its control.
8.3 The supplier will also not be liable for damages, losses and costs incurred by the buyer as a result of failure to execute the contract for reasons not attributable to him, as the purchaser is only entitled to a full refund of the price paid and any additional charges incurred.
8.4 In no case will the buyer be liable for delays or payment errors, if he proves that he made the payment in the time and manner indicated by the supplier.
9.1. For any dispute concerning distance sales, the civil court of the customer's place of residence or domicile will be competent, if located within the Italian State (art.12 D. lgt. 50/1992); in all other cases the Court of Catania will have jurisdiction.
